'They had a duty': Experts erupt over Trump lawyers' potential 'deception' on fraud bond

Donald Trump's lawyers may have made misrepresentations to the court regarding the former president's bond in his civil fraud case, and legal experts are looking out for what comes next.ProPublica reported on Friday that Trump's attorneys "had told the appellate court it was a 'practical impossibility' to get a bond for the full amount of the lower court’s judgment, $464 million.""But before the judges ruled, the impossible became possible: A billionaire lender approached Trump about providing a bond for the full amount," according to the recent report. "The lawyers never filed paperwork alerting the appeals court. That failure may have violated ethics rules, legal experts say."ALSO READ: A criminologist explains why keeping Trump from the White House is all that mattersThat news made its way around the internet over the weekend, with various people chiming in.ProPublica Illinois deputy editor Steve Mills asked the question, "Did Trump and his lawyers fail to disclose key details about his bond?"That led former federal prosecutor Andrew Weissmann to post a related reminder."And the $175 bond has reported issues: the surety company may not be licensed to give bonds in NY & may not have met the NY solvency reqs (can't post more than 10% of its worth so it is solvent to meet the bond requirements). 4/22 hearing scheduled by the court."Former prosecutor Barbara McQuade also chimed in:"AG is doing her job on behalf of the people of New York to inquire into whether Trump’s appeal bond meets legal standards," she wrote on Sunday in response to Weissmann. "The risk is that if Trump loses his appeal and he can’t pay the $454M judgment, then taxpayers lose."In response to ProPublica's piece, Trump campaign aide A.J. Delgado said, "Looking more and more like Trump did not, in fact, post the bond (at least not a proper one)."Speaking to MSNBC on Sunday, former federal prosecutor Renato Mariotti also said the lawyers involved have a "duty" to correct their statement. He noted that attorneys have additional obligations to be honest to the court.In the comments on the post from Mills, ProPublica's readers weighed in on the subject."Of course they 'neglected' to do this," Barbara Levitan, @BarbaraLevitan, wrote. "There are no accidents with Trump, only deliberate deception."Mary Miller, @eaglzfan1967, said, "THEY LIED - THEY HAD A DUTY TO CURE THEIR FALSE STATEMENTS."

'He can still talk about the case': Fox News host corrects Trump gag order lies

Fox News host Howard Kurtz reminded Trump campaign press secretary Karoline Leavitt that her boss could still talk about his hush-money case even though a judge put a limited gag order in place. While speaking to Leavitt on Sunday, Kurtz noted that former President Donald Trump had said he was willing to go to jail after Judge Juan Merchan prevented him from talking about court staff or the judge's family. "If this partisan hack wants me to put, wants to put me in the clink for speaking the open, obvious truth, I will gladly become a modern-day Nelson Mandela," Trump wrote about the gag order, Kurtz reported. "So why is he comparing himself to Mandela?" the Fox News host asked. "And is he now worried about going to jail in this case?" "No, not at all," Leavitt insisted. "Truth will ultimately prevail in this case and in all of the cases. The Democrats want President Trump confined to a courtroom." "Unfortunately, he'll have to be on trial in a dark, dirty New York City courtroom because Alvin Bragg is a far-left district attorney who has spent more time persecuting President Trump than prosecuting real violent criminals on the streets of New York," she continued. "President Trump is exposing the truth in all of these Biden-led witch hunts." "And that's exactly why you see these gag orders coming down," she opined. "Not only are they prosecuting him, but they want to silence him." "It's a complete violation of his First Amendment rights." Kurtz ended the interview with a correction. "He can still talk about the case," the Fox News host said. Hope Hicks, Donald Trump's 2016 campaign press secretary, will reportedly testify at the former president's hush money trial in New York. Sources told NBC News that Hicks could testify about her knowledge surrounding payments made to adult film star Stormy Daniels to cover up Trump's alleged affair. Hicks has previously testified before a grand jury in March 2023. "Now Hope Hicks, she per federal court records dating back to Michael Cohen when he pleaded guilty, he contended at the time that there was a phone call in which she latched not only Michael Cohen but with Donald Trump together," MSNBC's Vaughn Hilliard explained. "And so there's questions about on October 8, 2016, the day that Stormy Daniels came forward to the National Enquirer and said that she was ready to share her story but could potentially all but be paid off, that there were conversations that Hope Hicks was allegedly a part of." Hicks may have also been on a second call the same day that Cohen agreed to pay $130,000 to silence Daniels. "If you look at the transcript of Hope Hicks' transcribed interview with the January 6th committee, you see a person who at the end of her White House service did break somewhat with Donald Trump," Rubin recalled. "She didn't leave as acrimoniously as other people did." "She didn't share his belief that the election had been stolen, and that at the time was headline-making news, that Hope Hicks had essentially said to him, Mr. President, you and I don't see this the same way," she added. "So it remains to be seen what Hope Hicks will be like in a courtroom if she testifies, what her demeanor is like with Donald Trump, the defendant, sitting right in front of her." In order for Joe Biden the candidate to stay put as president, he must own April and all of autumn. For the next couple months, while Donald Trump will likely be defending himself in a Manhattan criminal court against charges he manufactured a hush-money scheme to silence porn star Stormy Daniels to help him win the White House — former Defense secretary and CIA director Leon Panetta thinks it opens up a chance for President Joe Biden to up his ground game and go on the offensive. "I think it's a critical moment here," he said during an interview on CNN. "I think Trump is in a difficult position. He's gonna be going into a trial; he's not able to go out and do a lot of campaign events." "This is a moment where a Joe Biden can basically dominate in the campaign arena," Panetta said. "So it is important that he get out to the country. It's important that they well-planned these campaign events to make sure that they are successful and that he continues to fundraise; all of those things are critical to his ability to be able to lay the groundwork for a strong campaign in the fall." The 45th president was indicted last year on 34 felony counts for covering up an alleged affair with Daniels by paying out a six-figure sum through his former attorney and fixer Michael Cohen (who was convicted in the scheme and served prison time) as political cover 12 days before the 2016 presidential election, which he won. The timing of the alleged incidents was critical since Trump was already reeling from the release of the infamous "Access Hollywood" hot mic video that had the real estate tycoon suggesting grabbing women's privates was acceptable if you're a big shot celebrity like him. The trial, set to begin jury selection on April 15, marks the first time a former president is being tried on criminal charges. Trump has denied the allegations and pleaded not guilty. Panetta made clear Biden has to mount an effective messaging strategy that stands on some of the foundations that landed him the presidency as Nov. 5 nears. "That messaging has to be about health care, about the Affordable Care Act that messaging has to be about the economy and what needs to be done to make sure we continue to improve the economy that messaging has to obviously deal with reproductive rights which is a critical issue."Watch below or click the link here.

White House reporter says new 'Trump document dump' vindicates Michael Cohen​

A new document dump paralleling the one in prosecutor Alvin Bragg's criminal case against Donald Trump appears to show the ex-president has been deceitful about his former lawyer, Michael Cohen.Brian J. Karem, the former White House correspondent who has previously given insight into how the ex-president might be feeling, wrote in an article published on Saturday that he had filed his own public records request on the Trump and Cohen case several years ago."The government lies," Karem declared before describing the multi-year process to obtaining the doc dump.ALSO READ: A neuroscientist reveals how Trump and Biden's cognitive impairments are different"Two and a half years ago, while doing some research, I filed a Freedom of Information (FOIA) request for information on former Trump fixer Michael Cohen and the investigation that led to his prosecution. Cohen gave me permission to pursue the information; he wanted it too," the reporter wrote. "So for the last two and a half years, with the assistance of brilliant FOIA attorney Mark Zaid and his firm, we have pursued the information to no avail. I’ve sat in Zoom meetings listening to excuse after excuse. I’ve appeared in court. Nothing has ever been done."That, however, changed when Bragg got his dump."Manhattan District Attorney Alvin Bragg’s office said federal prosecutors had provided about 73,000 pages of records since March 4 in response to a Trump subpoena filed in January. They appeared 'largely irrelevant,' but 172 pages were witness statements that Trump’s team could review before trial, according to a court filing from state prosecutors. For that reason, the Manhattan case has been delayed by 30 days," he wrote Saturday. "Not so coincidentally, around the same time the federal government responded with documents that I had requested on that same case two and a half years ago. But I didn’t get 73,000 pages. The government reviewed 32 pages and sent me 31."According to Karem, the data dump backed up what Cohen has said."There is very little that is new that the DOJ provided me – but it does help verify what Michael Cohen has long said – and been accused of lying about by Donald Trump," the report says. "Trump has long said that Cohen cannot be trusted – which makes you wonder why he ever hired him. But the evidence released shows that it was quite the contrary.
