A Georgia judge has set a Thursday hearing to consider dismissing a conspiracy case against
Donald Trump on First Amendment grounds. On Monday, Fulton County Superior Court Judge Scott McAfee ordered the hearing for March 28. McAfee is expected to consider motions from Donald Trump and other defendants in an
election interference case. Trump's motion asked the court to dismiss the case based on his First Amendment right to free speech. McAfee has dismissed two similar motions by co-defendants Kenneth Chesebro and Sidney Powell. Both co-defendants later pleaded guilty. According to the Atlanta Journal-Constitution, Trump would have to admit that his claims about the 2020 election being rigged were false to pursue a First Amendment defense. President Trump is premised on content-based core political speech and expressive conduct protected by the First Amendment," Trump attorney Steven Sadow argued in a court filing. Sadow asserted that the remedy for false speech "is speech that is true … not a state (racketeering) prosecution against the former president of the
United States." The Fulton County case focuses on efforts to overturn the election results in which Trump was defeated by Democrat Joe Biden. Specifically, officials in Georgia, including Fulton County District Attorney Fani Willis, have scrutinized a series of actions and communications by Trump and his allies aimed at influencing the state's election outcome. A pivotal moment in the investigation was a January 2021 phone call made by Trump to Georgia's
Secretary of State, Brad Raffensperger. During this call, Trump suggested that Raffensperger "find" enough votes to reverse Biden's narrow victory in the state. The advice "buyer beware" should rule the day when Donald Trump's Truth Social, which has never shown a penny of profit , starts trading publicly, financial writer Adam Lashinsky argued Monday. Lashinsky issued this warning in the
Washington Post one day before the former president's media company is slated to begin trading under the ticker name “DJT” on the Nasdaq Stock Market . The former executive editor for Fortune admitted he is not one to normally give investment advice, but argued the securities filing from the former president's Trump Media & Technology Group has enough red flags in it to give any investor pause. "I assure you that a company with $3.4 million in revenue and $49 million in losses over the past nine months is not worth $5 billion," Lashinsky wrote. "Buy into shares of any company with those numbers and you are certain to be taken for a sucker." ALSO READ: A criminologist explains why half of America does not care about Trump's crimes Lashinsky believes anyone who invests in the fledgling company stands a good chance of being "bamboozled" by putting money in Trump's pocket, arguing Securities and Exchange Commission filings contain a plethora of red flags about his business failures. After mentions of multiple business failures including bankruptcies, the filing, according to Lashinsky, includes the murky promise of growth based on "adhering to traditional key performance indicators, such as signups, average revenue per user, ad impressions and pricing … could potentially divert its focus from strategic evaluation with respect to the progress and growth of its business.” In short, Lashinsky labeled that gem as a "financial word salad," which he translated as: "Truth Social hasn’t amounted to much so far; pay no attention to our lack of specifics." "The Trump Taj Mahal, which was built and owned by President Trump, filed for Chapter 11 bankruptcy in 1991," the quotation reads. "The Trump Plaza, the Trump Castle, and the Plaza Hotel, all owned by President Trump at the time, filed for Chapter 11 bankruptcy in 1992.” The columnist pointedly singled out a warning that stated, "Trump Steaks, a brand of steak and other meats founded by President Trump in 2007, discontinued sales two months after its launch. … There can be no guarantee that [Trump Media’s] performance will exceed the performance of those entities.” Lashinsky told potential backers, "Investors who persist in backing Trump cannot say they weren’t warned." Trump's remarks came at a press conference after an appeals court reduced the bond he will have to pay in his
New York fraud case from $464 million to $175 million. "You mentioned the cash you have, you said on Friday it's something like $500 million," the reporter noted at a press conference. "You intend to put some of that into the campaign. Now that the bond's been reduced, are you going to start putting money into your campaign? You haven't done that since 2016." I might do that. I have the option. "But if I have to spend $500 million on a bond, I wouldn't have that option," he added. "I'd have to start selling things." Watch the video below or click here . CNN cut off live coverage of Donald Trump's public remarks at one of his Manhattan real estate properties, claiming that most of what he was saying was untrue. The former president spoke at 40 Wall Street after appearing in court in the
Stormy Daniels hush money case and following an appeals court ruling that dramatically reduced the bond he must post to avoid forfeiting some of his real estate holdings as a penalty in his fraud trial. But CNN cut him off halfway though and and launched into a fact check of his claims. "Violent crime is flourishing and we can't have that, you can't have that," Trump said. "No city should have that and it's happening in other cities, but not with the lawfare, the lawfare that they're doing is incredible. "So they could have done this in the case of the trial that we just left, one of the many that it goes on — every single one of them is run by [President Joe] Biden and his thugs, the only way they think they can get elected, and I think so far it's backfiring because the people of this country understand it. It's backfiring, but they're being run and they're running all of these different cases, so ridiculous, the cases, every one of them is ridiculous. You take a look at any one of them and you say, any one of them, it wouldn't make any difference. This is all weaponization of DOJ and
FBI." "They raided by house in violation of a thing called the Fourth Amendment, not allowed to do that," he added. "They raided my house in
Florida, Mar-a-Lago — no notice, no nothing, they raided it. I can't believe it, nobody can believe it, and we'll see how that all works out in the end, but it's illegal what they're doing. "It's criminal what they're doing and it's never been done before in this country, you can't have an election in the middle of a political season [sic]. We just had Super Tuesday now we had a Tuesday after Tuesday already and we had Louisiana the other day a couple of days ago, and we won in a record number, the highest number ever recorded, but we're in the middle of an election right now, and we're fighting crooked
Joe Biden, who's the worst president in the history of our country by far, who's let this country go to hell. The borders, millions and millions of people coming in from prisons, from mental institutions that terrorists, many people coming in from prisons and mental institutions, think of it, and terrorists are coming into our country, and this guy's just letting them come in by the millions. I think we have 15 million people already." ALSO READ: Here's why conservative elites are bailing on Trump now At that point CNN cut away to its studio team, and anchor Boris Sanchez explained that the ex-president was making too many false claims. "Trump laying out a plethora of falsehoods," he said. "Perhaps the most blatant one that, all of these criminal cases were orchestrated by President Biden. There is no evidence to support that. Just about every single one of the criminal cases went before grand juries that then elected to indict the former president, but of course he is using this moment as an opportunity to campaign, as we've often seen him do before." CNN's Kaitlan Collins then delivered an additional fact check on the former president's claims, which she said he often repeated in campaign rally speeches and on
Social Media. "Some of the classics there, including his claim that he repeats on a near daily basis this is about other countries emptying out their mental institutions and sending those people across the border, something his campaign has never been able to provide any factual basis for," Collins said. "But on the task get hand [Monday], which is these criminal cases and the fact that his first criminal case is going to be starting in three weeks with that jury selection after that decision was made here in the courtroom behind us by Judge Juan Merchan." Trump criticized Manhattan District Attorney Alvin Bragg, who charged him in the hush money case, and made misleading comments about former prosecutor Mark Pomerantz's book about the investigation . "[He] then detailed a book about the investigation they had been potentially pursuing against Donald Trump, including that they once considered bringing a racketeering charge against him," Collins said. "Trump did not mention that part of Mark Pomerantz's book, but clearly his anger here is that the judge and the fact that Judge Merchan did not allow this trial to get delayed any further than what had already was, which I should note it was supposed to start today."
